Many Novices Assume That Patents Protect Mere Ideas

Business, Entrepreneurship.

Information you should know about patents - there are many misconceptions about what a patent is and is not. Others believe that mailing yourself notes and drawings is a" poor man' s patent" that provides sufficient protection.

Many believe that patents can" protect an idea" in the sense of preventing people from acting on a concept you thought of. - in fact, patents are only granted to inventions, and the only way to achieve patent status is to apply for one and have it approved by the united states patent and trademark office. In exchange for these rights, and to assist in their being upheld, the inventor discloses the relevant details of his invention to the Patent and Trademark office. In the US, a patent is a set of exclusive rights granted to an inventor by the government or a set period of time. The two main parts of a patent are the specifications and the claims. For example, the creator of a new, lighter and more puncture - resistant bicycle tire might disclose that his tire employs a revolutionary new rubber alloy that is 50% more durable than anything currently on the market. A specification is where you describe the inner workings of your invention in gross detail.

He might further elaborate that the spokes of the tire are the result of a completely unique ergonomic design that the inventor and only the inventor knows, and that this design is what makes the tires lightweight. - claims are the part of the patent that explains precisely what this invention does, and is capable of doing. If the inventor receives his patent, this is what will be protected. Claims are where you define the invention and what it is from a customer' s standpoint. To get a patent, inventors must also typically include a drawing or prototype of their invention. So for example, you would state something like" Bicycle tire employing X proprietary rubber alloy for and Y spoke design to achieve maximum durability and lightness. " This illustrates, what your patented, concretely invention is.

Many novices assume that patents protect mere ideas. - in fact, this is not the case. That is, you can think of something, write down your idea in a patent application and own sole rights to it. To protect and foster innovation, the Patent and Trademark Office will only grant patents to those who create something based on an idea. Rather, what a patent does is give an inventor the right to exclude others from making, or selling the, using patented invention for however long the patent lasts. Contrary to popular belief, a patent is not a right to use the invention in question.

In the US, this is generally 20 years from the date of the patent being filed. - in most cases, the patent holder will seek monetary compensation for any past infringements. When and if it becomes necessary to enforce a patent, this can generally only be done through civil lawsuits. In addition to any damages, he will also seek an injunction. It is the court' s way of saying, "We know what you did, and it needs to stop. " To prove that a patent was infringed upon, the patent holder must prove that the infringer practices all of the requirements set forth in at least on of the patent' s claims. This is a court order prohibiting the infringer from infringing on the patent at any point in the future. Recall that a patent' s claims are literally the patent.

So if someone stole your spoke design and bribed your scientist into spilling your rubber alloy formula, you will most likely be successful in getting an injunction against that person. - they set forth exactly what it is that this invention does. Your patent will be recognized and upheld by the courts. Many believe it is possible to bypass the lengthy patent application process and high fees by simply mailing yourself an envelope with lots of sketches and idea notes in it. It is also worth putting a naive patent myth to rest. By sending it via federally certified mail, this supposedly" proves" that you were the first to conceive of an idea at a certain time. Courts will not recognize this as sufficient evidence that you have rights to an idea.

While this might be useful under certain circumstances, it alone will not provide you with the protection a patent does. - in short, the best advice for those seeking patent protection is to spend the money and consult a patent attorney. If you are thinking of staking your livelihood on a patent idea, these are the people whose advice you want to seek. These are people who have spent years studying the ins and outs of patents and patent law.

The Key Is To Taking Action On Your Knowledge

Business, Entrepreneurship.

Attending too many seminars? information overload can impede your success - seminars are a great way to stay abreast of changes and new information in any industry. No matter what your interests or desires, there are probably multiple seminars available providing good, reliable and effective information. The self - help industry uses seminars frequently to help people improve their lives.

If you frequently attend seminars, and find that you seem to be hearing the same information repeatedly, chances are you are a seminar junkie. - are you using the information you gain from each seminar you attend? Ask yourself one question? All too often people will attend a two or three day seminar, get all excited and full of energy ready to implement what they have learned. They may think to themselves, that was great information, I have to find time to use it. They come home and within a few weeks vaguely remember why they attended. Others will implement the knowledge the have gained for a few days and them drift back to their same daily routine.

Off they go and the same thing happens again. - a few months go by and then there is another seminar. Seminars are wonderful tools to help you implement change in your life. One new term describing this scenario is information overload. Attend too many without applying what you learn and you have just wasted your money. Information overload can eat away your time, and keep you from taking any action. Gaining knowledge and applying knowledge are two different concepts entirely.

If you have been exposed to several methods to perform a task, grow a business, solve a problem, or make investments, sometimes it creates a do nothing atmosphere. - it' s easy to gain the knowledge. Why? Consistently using and applying the knowledge may cause seminar junkies a problem. That' s the question you need to ask yourself if you are a seminar junkie. Disbelief, self, fear of failure - confidence, and even fear, doubt of success are common underlying causes of no action.

Usually there is another underlying cause for your lack of actions. - if you are ready to break your cycle here are a couple of suggestions. Review those you have recently( within the last year taken) . First, don' t sign - up for any more seminars. Ask yourself what you can do to use the information you gained at these seminars. Take the following point and burn it into your memory.

If you begin to come up with reasons why you can' t take action immediately, it' s time to delve deeper into what' s preventing your action. - any action you take can only result in one of two things, or failure, success. It' s a guaranteed fact that if you don' t take action you' ll fail. Nothing else. If you do take action and things don' t work out as planned, learn from your actions, and move on. You can attend seminar after seminar, but if you don' t use the knowledge you have wasted two very valuable commodities, your time and your money. The key is to taking action on your knowledge.

It is also good at this point to gather information from the relevant government regulatory bodies for childcare services.

Some of the areas that you need to think about are: - Do you have the necessary skills to manage a day care center? - How are you going to set up the business? - Are you going to start small with just a few children then build on that or are you going to hire people to work for you? - Do you have enough money to start one? - design a business plan that meets the regulations of your area. Collect all the information and work out a business plan that lays out step by step all that you need, what to do and when and how to go about it. You may look out online for information to guide you with the on what is needed to start and run a successful day care center when doing your business planning. Once you have the knowledge of how to set up a highly profitable and successful day care business, you have to build on it and do it right. There are also various guide books about starting a day care business.

Check with the local government to make sure that you meet the requirements in terms of meals, the maximum number, area per child of children per teacher that is allowed, fire and safety regulations and whether you need a registered nurse. - you may want to consider starting off small by providing baby - sitting services and then with your knowledge and experience you will be ready to take a leap from your baby - sitting service to a full - time day care business. With so much to think about, it seems a nightmare having to start a fully functioning child day care center.

Interpersonal Skills

Business, Entrepreneurship.

Starting a business? take inventory of what's in your skills portfolio - almost every start - up checklist that aspiring entrepreneurs will read, refers to the must know information about legal issues, sales, money management, marketing and operations. Fortunately, there are many resources available in the form of professional services or public agencies available to help us augment our own skills in these areas at affordable rates.

In fact, success as an entrepreneur not only relies on your knowledge and effective execution of these fundamentals, but also requires a constant commitment to keep growing and gaining knowledge in these areas. - as we busy ourselves getting on top of these business - technical skills to manage day - to - day operations, it doesn' t take long for us to realize that these skills, might not be, although essential enough. Maybe it is that other, start, less talked about - up check list - the one that speaks to the actual success behaviors necessary to successfully run and grow the business. What could be missing? Skills or traits such as judgment, agility, confidence, and creativity are some of the critical intangibles that are hard to measure and next to impossible to farm out. On the other hand, it might be, however hard for many of us to own up to having limited knowledge or weakness especially if we are fearful that admission might force us to shelve our dreams for business ownership. For most of us it' s relatively easy to look at the numbers and know if cash flow is good or bad or to look at a marketing plan and say if it worked or not.

The fact is, we can significantly enhance our chances of success if we take the time to inventory our skill set and put strategies in place to enhance the ones we can and seek help and support where we struggle. - however, with a little bit of introspection and honest evaluation of our preferences or behaviors, we can actually examine our own tendencies and put corrective action in place early. For most of us, much of this self discovery will take place on the job and our hope is that it will happen early enough to avoid serious consequences. The following simple assessment, albeit non - scientific, is one way to take inventory of our abilities in some of these non business - technical areas. Create a spreadsheet with five columns and label the columns as follows: Skill or Trait - List the following 20 traits. It is based on the well accepted principle which has been used successfully in the job interview for years - that past behavior is the best indicator of future behavior. Feel free to add others you know to be important.

Confidence. - agility. Courage. Decisiveness. Creativity. Self discipline.

Flexibility. - good judgment. Hard Worker. Multitask effectively. Leadership. Networking ability.

Openness to new ideas. - objectivity. Political Savvy. Self - starter. Resilience. Interpersonal skills.

Visionary. - risk tolerance. Rating - On a scale of 1 - 10, rate yourself on each of these traits with a" 1" meaning you have concerns about your strengths and a" 10" meaning you have confidence your skills are strong in this area. Strategy - Define a plan of action to address your shortcomings in any trait where your self score is less than a 6, especially if you consider it important to your business. Example - Identify the best example in your past that demonstrates your strength with regard to the trait or skill in question. Sensitivity - To help focus and prioritize your efforts, rank the skills and traits based on their relative significance to your business.

On the other hand if you run an in home day care, agility within very stringent government regulations might be a little harder and so you might choose to focus on your networking abilities to keep and gain new customers. - for example if you sell widgets via the internet, which are always, interpersonal skills important, might be less significant than agility to keep up with internet marketing trends. Column 3 is quite possibly the most important. If you have scored yourself with a high rating( 6 or higher) and cannot identify great examples in your past to support that ranking - you might need to rethink your self rated scores. It forces us as entrepreneurs to not just say how good we are, but to actually identify specific examples to demonstrate how we have acted in the past. Once you have completed the exercise yourself, ask someone whose opinion you value or potential business partners to complete a similar chart with their observations about you and each other. Brainstorm potential solutions and be open to the fact that it might come in many forms.

Comparing the results should give you a good idea of skills you have mastered and those which are potential weak areas you might need to address to improve you or your team' s chance of success. - one entrepreneur might choose to join business clusters to share ideas another could decide to create a board of advisors. Facing our fears head on will significantly improve our chances of success. No one path will fit everyone or every business model. The last thing we want as our businesses begin to grow is to find out that doing this personal inventory is long overdue and our skills bank is close to running on empty. Begin taking stock today!

What Is A Sleeve Tattoo

Business, Entrepreneurship.

Getting sleeved: full sleeve tattoos how to - what the heck is a sleeve tattoo and why would i care you ask yourself? For example not only what are they but how much do they cost, where can I get one? or How much time will it take to get a tattoo done. Well, sleeve tattoo are hot and a lot of people are curious about them.

This article contains a ton of useful information to get your started with sleeve tattoos. - so if you are wondering what i am talking about it is a large arm tattoo. What Is A Sleeve Tattoo? Sleeve just comes from the shirt sleeves that typically cover our arms and a sleeve tattoo is a full tattoo design that frequently covers up the whole arm in the tattoo design. For example a half sleeve tattoo is typically from the should down to the elbow or forearm area. You can get a variety of different lengths which will mean different amounts of the arms will be covered.

A full sleeve then is all the way down to the wrist with the tattoo design. - the individual design route usually works for people that have already gotten a few smaller tattoos on their arms and later they decide to connect them all together into one large design. The two most common way that people end up getting sleeve tattoos are either by individual designs or as one large design. The second way is to start out with a blank slate and completely do the design at one time. For example one might have a horseshoe tattoo for good luck on their bicep and want to connect this and extend the design down their arm. Connecting Tattoos: One way to end up with a sleeve tattoo is to take already existing tattoos that are on the arm and somehow find a unifying theme to connect them together.

So they might decide on some flames and a pair of lucky dice to go with the horseshoe. - this is not done by connecting up individual designs but instead starts with a blank slate and the design is unified and created at one time. One Project Method: Another way in which people will go about getting a sleeve tattoo design is to design the whole tattoo at one time. This can make for a wonderful looking sleeve tattoo that is very unified and well put together. You want to really take your time with this process and don' t get frustrated. Designs, Inspiration and Custom Work Once you have made the decision to get a full sleeve tattoo there is a good deal of work ahead of you before you start getting the ink done.

You see finding the perfect design can be difficult and most often you will not find any pre - made flash that will fit exactly what you want. - think about things you like and what you want the tattoo to represent. It is therefore advisable to instead take your time and really contemplate the tattoo design that you want to get. Then look at pictures and ideas from other people' s tattoos. Keep a journal or jot your ideas down some where. Find things you like and things you dislike about other people sleeve tattoos. If you spend some time looking online you can easily find a ton of tattoo designs and pictures of other people' s tattoo to get an ideas of what you want.

Below are some guidelines of more popular themes for sleeve tattoos. - what is hot: one place to get started with finding a design is to think about what you have seen and what is popular in sleeve tattoo designs already. However, these are just meant to spark an interest and should not just be used because they are popular. Sleeve Tattoo Ideas: Flames - One popular design theme that you can find on a good number of full sleeve tattoos are flames. You want your body art to express something about you so just use the ideas as inspiration. These typically start down at the wrist and the flames burn upwards towards the shoulder. Sleeve Tattoo Designs: Tribal - Tribal sleeve designs are another great tattoo design that can commonly be done as a sleeve.

This look great and can easily be incorporated with other designs or tattoos. - tribal tattoos are typically made up of large bold lines done in black and they look great from a distances and really stand out. Don' t feel you have to go with the standard tribal designs either as there are many different native cultures that used tattooing. Therefore they make great sleeve tattoos designs. You can go with something really unique like a Maori tribal design. Just think about Anthony Kiedis from the Red Hot Chilli Peppers. Tattoo Sleeve Ideas: Celtic - Another way to go and one that is very popular is to integrated a Celtic tattoo design into the sleeve.

He has a pair of wonderful Celtic forearm tattoos that could easily be extended into a full sleeve. - these again make use of bold black lines of ink which can be intricate and bold at the same time. There are step patterns, human and animal, spirals along with the classic knot work designs. Sleeve Tattoo Ideas: Floral Patterns - Flower tattoos can also make a great looking full sleeve tattoo. They are often very delicate and can look almost tribal depending on the design. More typically used by women, but in no way only for women, flower or floral tattoos can offer a wonderful look and feel about them. Flowers are also great design subjects because they offer a variety of symbolism behind them.

They can be rather costly and time consuming and so you want to plan ahead and ensure that you can complete the project before you get started designing it. - the time and cost factor: you should consider carefully the costs and time commitment involved in getting a full or even half sleeve tattoo. Typically it can take 25 hours of time to complete just the tattoo part of the work and this number can go up drastically depending on the design and the shop. Of course when they are super busy they are good but you will have to pay more. As far as cost it can be hard to project again it depends on the shop. the experience of the tattoo artist and the amount of work they currently have. Very rough guidelines in terms of price would be anywhere from$ 1, 000 to$ 2, 000 dollars.

They can make a wonderfully bold statement and a wonderful piece of body art. - if after reading all of the above you are still excited to get a full or half sleeve tattoo then by all means go for it. Just make sure you spend some time before getting started researching the design and the artist you want to work with. These are the two most crucial elements to getting a wonderful sleeve tattoo.

Catch A Dream

Business, Entrepreneurship.

A perfect time to start your home business - it was the day that changed course of my life. I had revealed him often how I would love to start my own online business from home and work towards financial independence. As we walked together on that empty road he asked me, "When are you starting with your venture? " He was a close friend.

He knew nothing about internet business. - something has come up. But he always heard me with attention and encouragement. "Quite a time has passed since you first mentioned. " He smiled as I remembered. "Next year. I do not think I will be able to do this year. " I replied. Things are not going to change much tomorrow than they are today. What he said was never expected, "If you do not have time this year and think you will have next year, you will never have the time. If you want to do it then do it now.

If you postpone, it will fizzle out. " Often I receive emails of people who ask when they should start their business. - as he parted after a long discussion he gave the final blow, "there will be no perfect time any day. I have passed through same kind of phase. Now is the right time for anything. I will repeat the advice my friend gave me. "NOW. " Yes! When we dream about a venture, knowingly or subconsciously we attach a state of perfection with that dream. When mind dreams it does with perfection.

It is a human habit. - but reality is different. Shall you wait so that things become better? You might already have prior engagements that won' t leave you with perfect state of conditions to pursue your dreams. Well! A dream has to pass through congested reality before it could be realized. The conditions did not improve in my case and as I see now they never become perfect.

Start now. - these are the most frequent questions that trouble the mind of a potential starter. # where do i get extra time required? The chaos which you face today would be present tomorrow also. Squeeze it. In case of business on the net, it is pretty manageable with small editing of your time management. # What if I do not have resources? You do not need much of a time to work on the net.

Well! - cut down dispensable expenses like movies or eating out. You need to search for what you can do. Borrow if you can. Okay. If you are sincere enough you will find a way. # I do not have a perfect plan. Start with imperfect one that you have formulated.

Start now. - you can modify it along the way if you need. There is plenty to learn in the way. And read this carefully. You cannot learn all before you start. Nobody starts with perfect plan. Action is what separates achievers from dreamers.

Things shape up as you walk the path. - it is very easy to dream. Dreaming is the first step towards any endeavor. There is no cost involved, no hindrance of any kind to stop the mind. But dream must be followed by action to realize that dream. World is full of wasted ideas and talents.

If it is not followed by action a dream has got no meaning. - don' t let that happen to you. Do not think tomorrow it will become better. Act now. Tomorrow the things will be same. - Now is perfect time. - Now you have the right finances. - Now you have the right knowledge to start. Make a plan and" Just do it. " Copyright(C) 2006 Arun Pal Singh Catch a dream.
